Terms & Conditions

Welcome to Balgowlah Heights Community Tennis. By participating in our programs and utilizing our services, you agree to the following terms and conditions, which aim to ensure a positive experience for all participants.​

  1. Term Classes & Competitions

    1.1 School Pickup & Supervision
    At specific Balgowlah Heights Community Tennis venues, parents should collect children immediately after class to avoid late fees. Please inform us in advance if your child is unable to attend due to illness for better planning.

    1.2 Make-Up Sessions
    Participants may avail up to two make-up sessions per term. Requests must be made via telephone with at least 24 hours’ notice. Cancellations within this period are not eligible for refunds or make-ups. Availability is limited, and bookings directly through telephone is advised. Notifications of changes or cancellations also require 24 hours’ notice for a new credit issue.

    1.3 Weather Conditions
    Outdoor sessions will be rearranged under adverse weather circumstances if feasible. Notifications will be sent through text if rescheduling is necessary, often not more than an hour before the start. Weather-related cancelled classes will have make-up options not affecting the two per term limit.

    1.4 Cancellations & Holidays
    Cancellations due to serious injury, relocation beyond 10 km, or job loss may qualify for a credit voucher, subject to proof and management approval. Automatic enrollment in the next term will occur if not cancelled two weeks before term start. Classes follow NSW public school terms and do not occur on public holidays.

  2. Private Sessions

    2.1 Scheduling and Cancellation
    Notify us 24 hours in advance to cancel; otherwise, full fees apply. No fee adjustments for absentees in semi-private sessions.

    2.2 Weather Changes
    Notification of lesson cancellations due to weather will be provided, with alternative makeup sessions arranged.

  3. Holiday Clinics

    3.1 Sign-In & Out Procedures
    Drop off and collect your child at the registration desk. Any alternative pickups should be communicated beforehand, and health needs must be flagged upon arrival.

    3.2 Weather Adjustments
    Indoor activities will be provided during severe weather when possible. If unavailable, notifications and alternative options including credits or rescheduling will be communicated by 8:30 AM.

  4. Tournaments

    4.1 Withdrawal Policy
    Withdrawals 48 hours prior to tournaments will result in a credit voucher. Cancellations within this period are not eligible for rescheduling or refunds. Weather-induced cancellations will be rescheduled and credited if attendance is not possible.

  5. 5.1 Equipment Rental
    Racquets and paddles can be rented, but lost or damaged items incur a fee of $100 per item.

  6. Media Use

    6.1 Photography & Filming Consent
    By joining our events, you agree to the capture of images and videos of you or your children for promotional use.

    6.2 Opt-Out Rights
    If preferred, you can directly request that images not be used, and we will comply with reasonable adjustments.

  7. Safety Assurance

    7.1 General Protocols
    Safety is a priority. Please follow all safety instructions and report any concerns immediately.

  8. Liability & Risk

    8.1 Acknowledgement of Risk
    By engaging in our programs, you acknowledge the inherent risks involved.

    8.2 Indemnification
    Participants agree to indemnify Balgowlah Heights Community Tennis against liabilities, excluding cases of misconduct.

  9. Phone Call Recordings
    Calls may be recorded for quality assurance and training.

  10. Participant Conduct

10.1 Behavior Expectations
Respectful conduct is expected from all guests. Rules and safety should be adhered to strictly. Non-compliance will result in service suspension

  1. Service Suspension and Termination
    Balgowlah Heights Community Tennis reserves the right to immediately suspend or terminate services or bookings if you or your guests violate any of the following terms:

  • Ignoring health and safety guidelines or other venue policies.

  • Engaging in behavior that jeopardizes the safety of others, disrupts the venue's harmony, or harms our reputation.

  • Providing false or misleading information.

  • Failing to settle outstanding payments within 14 days of the due date.

  • Abusive conduct towards staff, either verbally or physically.

  • Abusive conduct towards other participants or guests, either verbally or physically.

Non-compliance with any Terms and Conditions may lead to restricted services, suspension, or termination of services provided.

 

11. Physical Activity

11.1 Awareness of Risks
Engaging in our programs involves various physical activities. It is the responsibility of participants to ensure they are fit and capable of participating.

11.2 Medical Clearance
Individuals with existing medical conditions are encouraged to seek medical clearance before joining. Please inform us of any conditions, allergies, or health concerns that may influence your ability to participate.

  1. Modifications to Terms and Conditions
    Balgowlah Heights Community Tennis holds the authority to amend these Terms and Conditions at any time. Updates will be communicated through our website and other relevant channels. Continued participation in our programs after any changes signifies acceptance of the new terms.

  2. Additional Information
    These Terms and Conditions are designed to clarify the services provided by Balgowlah Heights Community Tennis. They do not limit or exclude your rights under Australian Consumer Law, as outlined in the Competition and Consumer Act 2010 (Cth).
